R v HM Peterborough Crown Court – Serious Assault

In this case the defendant had been accused of a very serious assault.  Prosecution relied on many different types of evidence one being the electronic monitoring tag which showed he was not present at home at the time the offence was committed contrary to what he had said in his police interview. Also the most crucial part of the prosecution’s case was they were heavily reliant on forensic evidence as the dna of the defendant had been identified on the victim.  We had instructed our own defence expert which challenged the prosecution’s evidence and made it clear that secondary dna transfer or cross contamination where very possible in these circumstances.  It had also come to light that clothing that was seized had been destroyed and no photos were taken. There was also statements  that had not been provided in relation to the taking of forensic samples by police. After much legal argument, and all prosecution evidence being challenged along with victim and witness being cross examined a Not Guilty verdict was given.
